These Terms of Service ("Terms") govern your access to and use of the AI User Safety website, resources, tools, and services (collectively, the "Services") provided by The Flourish Rapidly Company ("we", "us", "our"), trading as AI User Safety Initiative.

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Services Provided

We provide:

• Educational content and resources on AI safety and literacy
• The AI User Safety Assessment (an online self-evaluation tool)
• The AI Safety Digest newsletter
• Training, speaking, and advisory services for institutions
• The "Safe AI for Families" online course (hosted on Systeme.io)
• The SAFE AI User Manual (sold via third-party platforms)

2. Eligibility

• You must be at least 16 years of age to subscribe to our newsletter or use the assessment tool
• If you are under 18, you confirm that a parent or guardian has consented to your use
• Institutional services require an authorised representative to engage

3. Intellectual Property

• All content, frameworks, and materials on this site are the intellectual property of Dr. Gbemisola Adetayo and/or The Flourish Rapidly Company
• SAFE AI Framework™ is a registered trademark
• You may not reproduce, distribute, modify, or create derivative works from our content without prior written permission
• Limited personal, non-commercial use (e.g., printing a page for reference) is permitted

4. AI-Generated Content Disclaimer

In accordance with the EU AI Act and NIST AI Risk Management Framework:

• Some content on this site may have been created or assisted by AI tools
• All AI-assisted content is reviewed and approved by qualified humans before publication
• The AI User Safety Assessment may use automated processing to generate recommendations — these are informational only and do not constitute professional advice
• We do not use AI to make decisions with legal or similarly significant effects on individuals

5. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose
• Attempt to gain unauthorised access to our systems
• Scrape, harvest, or mass-collect data from the site
• Submit false, misleading, or malicious information through our forms
• Reverse-engineer or attempt to extract source code from our tools
• Use our content to train AI models without written permission

6. Newsletter & Communications

• By subscribing to our newsletter, you consent to receive periodic emails from us
• We use MailerLite to manage subscriptions (see our Privacy Policy)
• You may unsubscribe at any time via the link in any email
• We will not sell, rent, or share your email address with third parties for marketing

7. Assessment Tool

• The AI User Safety Assessment is provided for informational and educational purposes only
• Results do not constitute professional, legal, or technical advice
• We make no guarantee that following assessment recommendations will prevent all AI-related risks
• You are responsible for your own AI usage decisions

8. Third-Party Links & Services

• Our site contains links to third-party platforms (Amazon, Systeme.io, Google Forms, WhatsApp)
• We are not responsible for the content, privacy practices, or availability of third-party services
• Your use of third-party services is governed by their own terms
• Purchases made through Amazon or other retailers are subject to those platforms' policies

9. Institutional Services

• Training, speaking, and advisory engagements are subject to separate written agreements
• Fees, deliverables, and cancellation terms are specified in individual service agreements
• We accept purchase orders and institutional invoicing for qualifying organisations

10. Limitation of Liability

To the maximum extent permitted by law:

• Our Services are provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages arising from your use of the Services
• Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim (or £100, whichever is greater)
• Nothing in these Terms excludes liability for fraud, death or personal injury caused by negligence, or any liability that cannot be excluded by law

11. Indemnification

You agree to indemnify and hold harmless The Flourish Rapidly Company, its officers, and agents from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Services.

12. Data Protection

Our collection and use of personal data is governed by our Privacy Policy. By using the Services, you acknowledge that you have read and understood our Privacy Policy.

13. Modifications

• We may update these Terms at any time by posting the revised version on this page
• Material changes will be communicated via the newsletter or a site banner
• Continued use after changes constitutes acceptance of the updated Terms

14. Termination

We reserve the right to suspend or terminate your access to the Services if you violate these Terms, without prior notice. Upon termination, your right to use the Services ceases immediately.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory local consumer protection law provides otherwise.

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force and effect.
